COLOMBO : A three-judge Bench of the Supreme Court while postponing the considering of the bail application filed by Attorney Susil Priyantha Jayatunga who was suspended from practicing and remanded over his contemptuous behaviour in Supreme Court until May 5, recused themselves from considering this application yesterday (3).
Susil Priyantha Jayatunga was remanded until yesterday by a three-judge Bench comprising Justices Preethi Padman Surasena, Gamini Amarasekera and Kumuduni Wickramasinghe due to his disrespectful behaviour in Supreme Court on March 20.
His bail application was presented before Justices S. Thurairaja PC, Kumudini Wickremasinghe and Achala Wengappuli yesterday and informed Court that he represents himself in Court.
There, he informed court that he is suffering from a skin disease and his disease has deteriorated while being detained in remand prison.He also said that he is suffering from several other diseases and therefore requested to release him on bail.
However, Justices Kumudini Wickremasinghe and Achala Wengappuli informed that they will be withdrawing from hearing of the application as the respondent as an Attorney has lodged complaints against them.
Presiding Judge of the panel Justice S.Thurairaja, PC inquired from the respondent the number of judges against whom he has lodged complaints? The respondent replied that he was not certain about the exact number.
When inquired, the respondent informed that he has lodged a complaint with Keselwatte Police against Justice Thurairaja, PC as well. Accordingly, the presiding judge also informed that he also recuses from the consideration of the petition.
Meanwhile,the Court Registrar informed that the National Institute of Mental Health (NIMH) has informed in writing that it would be conducting an examination into the mental condition of the respondent as per the directions of court.
Accordingly the hearing of the bail application was postponed until May 5 and the Supreme Court informed that it would be considered before a different bench of judges on that day and ordered to detain the respondent in remand custody until the case is concluded.
When the respondent was remanded on the previous occasion, the Supreme Court ordered the Attorney General to file a charge sheet against him for violating the professional ethics and to prosecute him over the charges of contempt of court under the Contempt of Court Act No.8 of 2024.In addition, his enrollment as an Attorney was also suspended indefinitely.
