COLOMBO: The Court of Appeal two-judge-bench comprising Justice (President) Nissanka Bandula Karunaratne and Justice M.A.R. Marikar issued an interim order reinstating H.M. Janaka Ravindra Kalupahana as the Basnayake Nilame of the Soragune Kuda Katharagama Devalaya.
The petitioner Janaka Ravindra Kalupahana without a proper hearing had been suspended from the Soragune Kuda Katharagama Devalaye by a letter dated January 26, 2023 on purported allegations.
Representing the petitioner, President’s Counsel Farman Cassim said the plaint filed claims that the suspension of his client violates the rules of Natural Justice, asserting that the provisional appointment to the position of Basnayake Nilame of Charitha Sebastian Prabodha Nugawela to replace the petitioner was unlawful and malicious.
The court granted further interim relief staying the said provisional appointment, paving way for Janaka Ravindra Kalupahana to be reinstated. The case will be called on the March 31.
President’s Counsel Farman Cassim and Attorneys-at-Law, Budwin Siriwardena and Vinura Kularatne instructed by R.M. Chamali S. Ranathunga, Attorney-at-Law represented the petitioner. Deputy Solicitor General Manohara Jayasinghe and Attorney-at-law Mihiri de Alwis appeared for the respondents.
