COLOMBO : Judge from the Chief Magistrate Court Thilina Gamage reserved his order for 17/06/2022. On Dan Priyasad’s bail application which was heard on Friday, June 3.
Dan Prasad was arrested in complaints that he was involved in the violence against protesters on May 9
The case was heard and Senior Attorney Jayantha Dias Nanayakkara submitted a written show-cause on behalf of Dan Priyasad pleading not to cancel his previous bail.
Senior Attorney Shiraz Noordeen demonstrated to courts, how Dan Priyasad has violated his bail on many occasions. Mr. Noordeen submitted 8 police complaints made against Dan Prasad from 2016 to 2019, further a case record of Colombo chief Magistrate Court – No.02, where Dan Prasad was a suspect for Racial disharmony. Noordeen also submitted a case record of Mount Lavinia Magistrate Court, where Dan Prasad was the main suspect in an attack on the UNHRC refugee facility for Myanmar refugees at Mount Lavinia.
Further, it was brought to the notice of the court, of many social media contents, where Dan Prasad has shown his prior intention of attacking properties of a minority community and then proceeded to do so, as he did in Mainagogama and Gotagogama.
Fort Police was present in courts and didn’t submit any reports against the said, Dan Prasad.
Abeyratne Suresh Priyasath alias “Dan Prasad” played a major role in the infamous 9th May 2022 attack on Mainagogama and Gotagogama protesters.
He was not arrested till the 16th May 2022 for the said offence.
On 17th May 2022, a group of lawyers provided CID and OIC- Fort Police with sufficient evidence of Dan Prasad’s involvement in Mainagogama and Gotagogama attacks along with his previous pending case records and police complaints made against him.
Subsequently, he was arrested by the CID on the same day and produced to courts on 18/05/2021.
He is still in remand custody with relation to Gotagogama and Mainagogama attacks.
On the 18th, a team of lawyers led by Maithri Gunaratne PC and Shiraz Noordeen made an application to courts to cancel his previous Bail on a pending case, since he has committed offences while remaining on bail. Accordingly, Hon. Judge fixed an inquiry on 03/06/2022 to ascertain why he should not cancel the existing bail of Dan Prasad as per sections 14(A)iii and 14(B) of the Bail act.
