COLOMBO : The suspect namely Mudiths Jayasekara has been arrested and produced before Chief Magistrate’s courts today for defaming Islam through his Facebook account.
CCID informed courts that suspect has committed an offence under section 291A and 291B of the Code.
Lawyer for the suspects moved for bail sighting medical reports, that suspect is mentally retarded.
Senior Attorney Shiraz Noordeen appearing for the Muslim virtual complainants, informed the Hon Judge that, in these circumstances a Magistrate should act under section 374 of the Criminal Procedure Code to ascertain an official medical certificate of the suspect. And till then suspect to be kept in remand custody due to the fact that he is danger to society and himself. Further Mr.Noordeen raised the question that, why the CCID is not opting to file charges under ICCPR as they do in other cases.
Judge ordered court registry forward the suspect to an appointed Government Medical officer to get medical certificate of his mental status.
Suspect is granted Bail and case will be taken up again on 30/11/2023 to rule out suspects medical conditions.
It is notable that 14 complaints were made against this suspect including non Muslims.
