
COLOMBO : A special training course for Quazii Judges from various parts of Sri Lanka was successfully held recently under the auspices of the All Ceylon YMMA Conference at its auditorium located in Dematagoda, Colombo 9.
The event, which was held with the full support of the Judicial Service Commission, was a major initiative to further strengthen the justice delivery process under the Muslim Personal Act (MMDA) of Sri Lanka.
A large number of Quazis representing Colombo North, Colombo South, Kattankudy, Sammanthurai, Kinniya, Matale, Maho, AkuranaThumparai, Udatalawinna, Udunuwara, Mawanella and Badulla participated in the training workshop.
The training was organized by the Sri Lanka Qadis’ Federation (SLQJF). The entire session was chaired by Al-Alim A.L.A.M. Faux (MA), Advisor and Past President of the organization. The current President, Ibham Yehia, and Secretary, Amhar Sharif provided guidance for the program.
Key Objectives of the Training
The primary objective of the training was to enhance judicial capacity, discipline and unity in the proper implementation of the procedures of the Muslim Marriage and Divorce Act (MMDA). Particular attention was paid to the following areas:
Case Recording: Accurately documenting the proceedings of the case.
Legal Procedures: Proper procedures for Sections 27, 28 and 30.
Divorce Applications: Handling Fasakh and Mubarah applications.
Judgments: Providing reasoned judgments based on evidence.
Conciliation efforts: Conciliation initiatives in maintenance, custody and family matters.
Key points discussed
The emphasis was on ensuring transparency in the courts and implementing uniform interpretations in accordance with the principles of Islamic Fiqh. Also,
Judicial discipline: Impartiality and respectful court behavior.
Legal awareness: Recent developments regarding the MMDA amendments.
Experience sharing: Discussion on the challenges faced by Qadi judges in different regions.
Conclusion : The organizers said that such trainings are essential to enhance the quality of Qadi courts and protect the rights of the public under personal law.
The Sri Lanka Quazi Magistrates Association has assured that such capacity building programs will be carried out continuously in the future.
